Pet Agreement
I/We apply for permission from the Owners Corporation to keep the pet listed in this application and agree to comply with the following conditions should approval be granted:
Pet Application – Terms and Conditions
By submitting this pet application to the Owners Corporation, the undersigned acknowledges and agrees to the following terms and conditions in relation to the assessment, processing, and determination of the application.
1. Authority to Submit Application The undersigned confirms that they are the registered proprietor of the lot to which this pet application relates, or that they are duly authorised by the registered proprietor to submit the application on their behalf. Where the undersigned is not the registered proprietor, the undersigned warrants that they have obtained the lot owner’s authority to submit this application and to accept and agree to all costs and obligations arising from it.
2. Assessment of Pet Application The undersigned acknowledges that the pet application must be submitted to the Owners Corporation for consideration and determination in accordance with the applicable by-laws, legislative requirements, and any relevant NSW Fair Trading guidance. The undersigned further acknowledges that the Owners Corporation is required to consider the pet application on its merits and, where the application is refused, the reasons for refusal are to be documented and provided in writing.
3. Responsibility for Costs The undersigned acknowledges that all costs incurred by the Owners Corporation in connection with the review, assessment, administration, and determination of this pet application are the responsibility of the lot owner / applicant. These costs may include, but are not limited to: (a) strata management administration and review fees; (b) preparation of meeting notices, agenda material, motions and minutes; (c) correspondence with the applicant to obtain missing information or clarification; (d) costs associated with convening a Strata Committee Meeting or General Meeting of the Owners Corporation; (e) disbursements and out-of-pocket expenses incurred by the Owners Corporation; and (f) any legal or professional costs incurred where additional advice is required.
4. Meeting Costs and Additional Review Charges (ex GST)
The undersigned acknowledges and agrees that the following charges apply in connection with the processing of this pet application:
The undersigned acknowledges that where the information submitted with the application is incomplete, unclear, inconsistent, or insufficient to allow the Owners Corporation to properly consider the application, additional review time may be required by the Strata Manager to assess the material and seek further information from the applicant. Such time will be charged at the rate set out above.
5. Complete and Accurate Information The undersigned agrees to provide complete and accurate information in support of the pet application, including any information reasonably required by the Owners Corporation or Strata Manager for proper consideration of the request. This may include, where relevant: (a) details of the animal, including breed, age, size and weight; (b) vaccination, registration and microchip details; (c) photographs of the animal; (d) details of how the animal will be supervised and managed within the scheme; and (e) any other information reasonably requested by the Owners Corporation.
6. No Guarantee of Approval The undersigned acknowledges that payment of the applicable fees does not guarantee approval of the pet application. All applications remain subject to the decision of the Owners Corporation in accordance with the relevant by-laws, legislation, and the particular circumstances of the application.
7. Authority to Debit Costs to the Lot Owner Ledger The undersigned irrevocably authorises the Owners Corporation to debit all costs incurred in connection with this pet application, including meeting costs, review fees, additional clarification fees and disbursements, to the lot owner’s ledger as a debt due and payable to the Owners Corporation. The undersigned acknowledges that any unpaid amounts may be recovered by the Owners Corporation in accordance with the applicable strata legislation.
8. Written Outcome The undersigned acknowledges that the outcome of the application will be recorded by the Owners Corporation and notified in writing. Where the application is refused, the reasons for refusal are to be documented.
By submitting this pet application, the undersigned acknowledges that they have read, understood, and agree to be bound by the above terms and conditions and accept responsibility for all costs incurred by the Owners Corporation in connection with the review and determination of this pet application.
